Ashford Schael represents commercial landlords in Chapter 11 and Chapter 7 bankruptcy cases.  Commercial landlords have enhanced rights and protection in bankruptcy cases and debtors are required to continue to pay rent and perform obligations under a commercial lease after a bankruptcy is filed.  Prior to assuming a commercial lease, debtors are required to cure all monetary defaults, compensate for actual pecuniary losses and provide adequate assurance of future performance.  Ashford Schael protects and enforces these rights for landlords both with consensual arrangements with debtors or trustees and enforcement proceedings in the Bankruptcy Court.

Vendors and Suppliers

Ashford Schael represents suppliers and vendors in Chapter 11 and Chapter 7 bankruptcy cases.  Suppliers of goods have certain enhanced rights and remedies in bankruptcy cases.  Suppliers who delivered goods to a debtor within certain time periods prior to the debtor filing for bankruptcy may be entitled to an enhanced claim with priority payment over other unsecured creditors.  Suppliers may also be able to seek reclamation of goods in shipment when the bankruptcy case is filed.  As a supplier it is important to immediately contact an experienced bankruptcy attorney if your customer is delinquent or shows other signs of credit risk.
